Terms of Service

These Terms of Service (the "Terms") govern your use of fiund.com and the fiund contributor portal (together, the "Service"), operated by fiund ("fiund," "we," "us"). By using the Service you agree to these Terms. If you are using the Service on behalf of a company, you represent that you have authority to bind that company, and "you" means that company.

1. What the Service is

fiund is a licensing marketplace for real-world audio, video, and UGC training data. Data owners ("Contributors") submit content through the contributor portal; fiund catalogs it and licenses it to AI teams ("Buyers") under written agreements. The public website provides information and research about the AI data-licensing industry.

2. Accounts

Portal access is invite-only. You must provide accurate information, keep your credentials confidential, and notify us promptly of any unauthorized use of your account. You must be at least 18 years old, and able to form a binding contract, to open a portal account. We may suspend or close accounts that violate these Terms.

3. Contributor content

Content you submit remains yours. Licensing of contributor content to fiund and onward to Buyers is governed by the Contributor Licensing Agreement you sign inside the portal before submitting content — including its license grant, revenue share, payment terms, representations, and withdrawal rights. If these Terms conflict with a signed Contributor Licensing Agreement, the signed agreement controls for that subject matter.

By submitting content you represent and warrant that:

  • you own the content or control all rights needed to license it for AI training;
  • your submission does not infringe any third party's intellectual property, privacy, publicity, or contractual rights (including any exclusive license you have granted elsewhere); and
  • the information you provide about the content (ownership, releases, licensing history) is accurate.

4. Acceptable use

You agree not to:

  • submit content you do not have the right to license, or content that is unlawful, or that was scraped from third-party platforms in violation of their terms;
  • misrepresent ownership, consent, or provenance of any submission;
  • probe, disrupt, or attempt to gain unauthorized access to the Service or other users' data;
  • use the Service to build a competing dataset catalog from content you do not own; or
  • share your invite or account access with others without our consent.

5. Intellectual property

The Service — including the site, portal, design, and editorial content — is owned by fiund or its licensors. We grant you a limited, revocable, non-transferable license to use the Service for its intended purpose. Except for your own content, you may not copy, scrape, or redistribute the Service or its contents without permission. Nothing on the public site is legal advice.

6. Takedown

We respond to copyright complaints under our DMCA Policy and honor contributor withdrawal rights as set out in the Contributor Licensing Agreement.

7. Disclaimers

The Service is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that any submission will be licensed or generate revenue, and industry information on the site is provided for general information only.

8. Limitation of liability

To the fullest extent permitted by law, fiund will not be liable for indirect, incidental, special, consequential, or punitive damages, or lost profits or revenues. Our total liability for any claim arising out of the Service is limited to the greater of (a) amounts we owe you under a signed Contributor Licensing Agreement for the content at issue and (b) one hundred US dollars (US$100). Nothing in these Terms limits liability that cannot be limited by law.

9. Indemnification

You will indemnify and hold fiund harmless from claims arising out of your breach of the representations in Section 3 or your violation of law in connection with content you submit.

10. Termination

You may close your account at any time. We may suspend or terminate access for breach of these Terms. Provisions that by their nature should survive (including Sections 3, 7, 8, 9, and 11) survive termination. Termination does not affect rights and obligations under a signed Contributor Licensing Agreement, which is governed by its own term and termination clauses.

11. Governing law and disputes

These Terms are governed by the laws of the State of Arizona, USA, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Maricopa County, Arizona, and you consent to their jurisdiction. Before filing any claim, you agree to contact us and attempt in good faith to resolve the dispute informally for 30 days.

12. Changes

We may update these Terms from time to time. Material changes will be announced on this page with an updated effective date, and — for portal users — by notice in the portal. Continued use after changes take effect constitutes acceptance.
